Conditions for Booking on This Website

The following conditions apply to the booking service provided to you by the company defined below (“we”, “us”, “our”). The booking service includes this website, the software associated with the website, and the ability to enter into transactions with certain parties whose content appears on the website. You agree to these conditions in relation to the booking service, in addition to the terms and conditions of your rental agreement, which apply directly between you and the selected third-party provider (“Third-Party Provider”).

If you choose to make a booking, you do so at your own risk and accept that you may:
(i) be unable to travel as planned and may be required to pay cancellation fees.

Disclaimer for Information

In very rare cases, a price may be displayed incorrectly due to an error on our part or on the part of a Third-Party Provider. If you make a booking at an incorrect price, we will notify you of the price change and give you the option to proceed with or cancel the booking. We make reasonable efforts to keep the information on our website up to date; however, we cannot guarantee that the website is free from errors or omissions and reserve the right to update or change any published information at any time.

Liability

To the maximum extent permitted by law, we are not liable to you or to any third party (whether in contract, tort, or otherwise) for any direct, indirect, incidental, or consequential loss or damage, or for any accidents, injuries, illnesses, delays, or loss of use arising from reliance on the information contained on this website, including but not limited to the use of (or inability to use) products or services described on or purchased through this website.

Your rental and use of any vehicle booked through our website are subject to the terms and conditions of the rental agreement with the Third-Party Provider. The rental agreement and all other documentation provided by the Third-Party Provider apply solely between you and the Third-Party Provider. We are not liable to you or to any third party in relation to that agreement, your vehicle, or your rental service once your booking has been properly processed by us.

We are not responsible or liable for:
(i) the acts or omissions of the Third-Party Provider in connection with your booking or during the provision of the rental service; or
(ii) any disputes relating to your booking or rental service with the Third-Party Provider, except to the extent that liability is imposed on us by applicable law.

You agree to indemnify and hold us harmless, to the fullest extent permitted by law, from and against all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of a vehicle booked through our website, provided that we have properly processed your booking. This includes, without limitation, any accidents, injuries, illnesses, losses, or damages of any kind related to your use of the booked vehicle.

While we make reasonable efforts to represent reputable Third-Party Providers only, we make no warranties regarding the suitability, fitness, or safety of third-party products or services and accept no responsibility for the quality, condition, suitability, or hygiene of any vehicle (including the presence of viruses in a vehicle).

If you experience any issues with the vehicle during your rental, you MUST report them directly to the relevant Third-Party Provider as soon as possible. This allows the provider to address the issue and minimize inconvenience. Failure to report issues during the rental period will likely result in no compensation being offered.

If, despite the above, we are found liable to you in connection with your booking or these terms, our total liability will be limited, at our discretion, to either:

  • the re-supply of the booking service; or

  • a monetary amount equal to:
    (i) the deposit paid by you in relation to the booking; or
    (ii) if you paid the full price at the time of booking or are required to pay the full amount at the rental counter, 20% of your total booking price (representing an estimate of the commission we may receive for providing the booking service).

We strongly recommend that you take out comprehensive travel insurance. Use of this website is governed by the laws of New Zealand, and you submit to the exclusive jurisdiction of the New Zealand courts.

Booking Information

To make a booking, you must complete our booking form, which is user-friendly and secured with the latest encryption technology. Upon receipt of your booking request, we will check availability and conduct any fraud checks we consider appropriate (which may include requesting additional information). At this stage, we may decline your booking.

If your booking is confirmed, we will send you a confirmation voucher and invoice by email. The deposit required to secure your vehicle (as shown on the secure booking page) will only be processed once your booking has been confirmed. Please note that an additional payment processing fee (as disclosed at the time of booking) may apply.

A booking is confirmed once you receive a confirmation voucher by email and your initial payment has been successfully processed. If this payment is non-refundable or subject to cancellation fees in accordance with the Third-Party Provider’s terms, it will become non-refundable or subject to such fees at that time. Please review your confirmation carefully and notify us immediately of any errors, as changes may not be possible later.

You acknowledge and agree that we may receive a commission, revenue share, technology service fee, or marketing fee in connection with bookings and other transactions made through our booking service or website.

Adding Delegates to Your Booking

For some bookings, you may add a delegate authorized to act on your behalf and make changes to the booking. A delegate must be at least 18 years old and may modify all aspects of an existing booking, including changes that incur additional charges. However, only you may cancel the booking or add or remove participants.

If you add a delegate, you agree to:

  • obtain the delegate’s consent before providing us with their personal information; and

  • accept all changes and any additional costs incurred by the delegate acting on your behalf.

Insurance

Third-party insurers may offer certain types of rental vehicle travel insurance (“Insurance”) for purchase through the website. Before purchasing insurance, you must read and consider the Product Disclosure Statement. All insurance policies, descriptions, disclosure statements, and related materials are prepared and provided solely by the third-party insurer.

If you purchase insurance:

  • you enter into a contract directly with the third-party insurer;

  • we do not act as an insurer and do not provide the insurance;

  • we accept no responsibility or liability for the insurance, including claims made under it;

  • the calculation of a “day” under the insurance policy may differ from the calculation of a “day” under your vehicle booking. Unless otherwise stated, the insurer will offer coverage sufficient for the duration of your booking, which may result in coverage for additional days;

  • we may receive a commission or other fee from the insurer in relation to any insurance policy purchased through our website.

Disclosure of Information

By making a booking on this website, you consent to us disclosing your information to:
(i) the selected Third-Party Provider, to enable them to provide the requested rental services; and
(ii) our third-party insurance provider, to enable them to offer insurance (where applicable), or as otherwise described below.

By booking through the website, you also consent to receiving an insurance offer by email from us or our third-party insurance provider in relation to your booking. Third-Party Providers, insurers, or marketing partners may have privacy policies that differ from ours.

Amendment Requests

Please note that some Third-Party Providers treat amendments as new bookings and may reprice the entire booking at the rate applicable at the time of the change (not just the amended days). If the rental period is extended, an additional deposit may be required. If the rental period is shortened and results in a reduced rental cost, the original deposit (if any) will remain unchanged and any difference will be forfeited and cannot be applied to the remaining rental charges.

To request a change to a confirmed booking, please use the amendment request link provided in your confirmation. All amendments are subject to availability and approval by the Third-Party Provider. In addition to the Third-Party Provider’s amendment policies, the following fees may apply to changes made through our booking service. No amendment fee will be charged if the requested change is not possible.

Refunds and Cancellations

We aim to provide a high-quality service and strive for full customer satisfaction. In the event of a cancellation, all applicable refunds, credits, or cancellation fees are governed by the terms and conditions of the Third-Party Provider of your selected vehicle. The booking deposit is non-refundable in the event of cancellation.

If you are dissatisfied with our booking service, please contact us within 48 hours of your booking or enquiry, and we will make reasonable efforts to resolve the issue and determine whether compensation is appropriate.

In some cases, a booking may need to be cancelled due to circumstances beyond the control of either party, such as severe weather, public health events (including epidemics or pandemics), medical emergencies, strikes, terrorist acts, government or regulatory restrictions (including travel restrictions related to COVID-19), or changes in law. In such cases, you may be entitled to a credit or refund in accordance with the Third-Party Provider’s terms and conditions.

You agree to resolve any disputes regarding refunds or cancellations directly with the Third-Party Provider, regardless of whether the cancellation was initiated by you, the provider, or due to circumstances beyond either party’s control, including government restrictions, the COVID-19 pandemic, or the insolvency of the Third-Party Provider. Once payment has been made, you must not initiate a chargeback or reversal through your card issuer without our prior consent.

Refund processing times may take up to 12 weeks from the date of your refund request. This is outside our control.

We are not responsible or liable (including for negligence) for any failure or delay by a Third-Party Provider in supplying travel products once your booking has been properly processed.

Payment Processing Fees

We may charge a payment processing fee in connection with processing your booking payment. Payment processing fees are charged by us in our own capacity as merchant and not as an agent for any other party. These fees cover reasonable costs associated with payment processing, including fraud prevention and fees charged by payment service providers. Payment processing fees are charged in addition to the cost of the selected vehicle.

This website is owned and operated by CamperWorldWide Limited, a company incorporated in New Zealand. CamperWorldWide Limited provides the booking service and is the entity with whom you enter into a contract under these terms. Depending on your chosen payment method, your deposit may be collected by us, and the balance may be collected by us or by the vehicle rental provider.
